Introduction and who is collecting your personal data?
The below explains how Norwest Exploration Services Pty Ltd and/or its affiliates ("Norwest"; "we"; “the Company”) protect the personal data we process and control relating to you (“your personal data”; "your data") and which rights you have in relation to the processing of your personal data if you use Norwest’s online career resources when you apply for a job at Norwest when you are interested in applying for a job and when undertaking pre-hire and/or onboarding actions.
What personal data will Norwest collect?
The types of information requested from you and how information is collected and accessed are determined by the requirements of the country where the position is located and not the country in which you reside.

All personal information collected via the above websites and portals is achieved when you supply personal information to the website or portal. Sometimes, the Company may receive personal information such as a resume/CV from a person or entity who is a third party on behalf of another person whose personal information is being shared.
By interacting with our websites and portals in this manner, you consent to the collection, management, storage and sharing of your personal information in accordance with this Privacy Policy.

What is “personal information”?
The Privacy Act 1988 (Cth) currently defines “personal information” as meaning information or an opinion about an identified individual or a reasonably identifiable individual:
whether the information or opinion is true or not; and
whether the information or opinion is recorded in a material form or not.
Suppose the information does not disclose your identity or enable your identity to be ascertained. In that case, it will in most cases not be classified as “personal information” and will not be subject to this privacy policy.
Norwest will collect the following categories of data:
Your personal details
Data requested to provide during the recruitment process, to the extent allowed by applicable law
Data you submit in résumés / CVs, letters, writing samples, or other written materials (including photographs and videos)
Data generated by interviewers and recruiters, based on their interactions with you or basic Internet searches where allowed under applicable law
Data provided by third-party placement firms, applicant matching platforms, recruiters, or job-search websites, where applicable
Photograph, and images/audio/footage captured in the course of recruitment events or video recruitment interviews
Recommendations provided on your behalf by others
Documentation required under immigration laws
Data about your prior employment, education, and where applicable, credit history, criminal records or other data revealed during background screenings
Personal health and medical declarations, or disabilities
Injuries and rehabilitation information
Details of your medical service providers
Any previous workplace incidents, accidents, reports that pertain to you personally
Copies of Passport pages used for verifying your right to work in Australia
Photo and other identification – licences, birth certificates, etc.
Racial or ethnicity information
Details of trade union membership/s or employee groups
To the extent legally permissible, data about your health or disability where it is relevant to your ability or availability to work or a workplace accommodation, subject to legal limits on the timing of such data collection and other applicable limitations.
Data generated by your participation in psychological, technical or behavioural assessments. You will receive more information about the nature of such assessments before participating in any of them.
You are not required to provide any requested information to Norwest, but failing to do so may result in your inability to continue your candidacy for the job for which you have applied.
By submitting your information, you acknowledge that all representations made by you are true and correct to the best of your knowledge and belief, and you have not knowingly omitted any related information of an adverse nature. Providing any inaccurate information may make you ineligible for employment.
Sensitive Information
Sensitive information is a special category of personal information under the Privacy Act 1988 (Cth). The sensitive information we may require access to has been listed in the information we collect. Still, specifically, it is the information or an opinion about you, including racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership or a professional or trade association, membership of a trade union, sexual preferences or practices, criminal records, and health information.
As part of our services, we may arrange health surveillance, drug and alcohol testing, medical testing, or police checks as required by our clients or legislation.
How we collect your personal information
We may collect personal information from you whenever you input it into the websites or portals that we use in our operations.
We may collect information when you converse with us on phone calls or emails, or in the office wherever you complete forms or paperwork.
We may collect information about you that is publicly available, such as your LinkedIn profile or similar platforms.
We also collect cookies from your computer, enabling us to tell when you use the website and help customise your website experience. Generally, however, it is not possible to identify you personally from our use of cookies.
Why will Norwest process your personal data and on which basis?
Norwest will not use your personal data for purposes that are incompatible with the purposes listed in this privacy policy, unless it is required or authorised by law, or it is in your own vital interest (e.g. in case of a medical emergency) to do so.
We collect personal information to provide you with the best service experience possible on our website, portals, and elsewhere.
We customarily disclose personal information only to our service providers who assist us in operating the websites, portals, and online storage systems. Your personal information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties.
We also share some information of potential and actual labour hire employees with potential or actual host employers, as well as information of permanent job seekers. This is deemed necessary in our operations, to identify and deploy labour hire employees into suitable employment with host employers or direct employers.
Additionally, we may disclose personal information to our insurers, workers' compensation bodies or groups, contractors or suppliers who are directly involved in the Company's recruitment operations, and any other person with a lawful entitlement to access the information.
By using our websites and portals, you consent to receiving direct marketing material. We will only use your personal information for this purpose if we have collected such information directly from you and if it is material of a type which you would reasonably expect to receive from us. We do not use sensitive personal information in direct marketing activity. Our direct marketing material will include a simple means by which you can request not to receive further communications.
Access and correction
Australian Privacy Principle 12 permits you to obtain access to the personal information we hold about you in certain circumstances by request. Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions.
Our websites and portals that you have login credentials for will also enable you to add your personal information. If you would like to change, modify, or delete information held by the Company, you must contact the Company by emailing admin@norwestexploration.com.au.
How long will Norwest retain my personal data?
If you are given and accept an offer of employment by Norwest, personal data collected during your pre-employment period will become part of your Norwest personnel records, to be retained throughout and for a period after your employment with Norwest. If Norwest does not employ you, Norwest may nevertheless continue to retain and use personal data collected during the recruitment process to consider you for new positions and, if appropriate, to refer back to an earlier application if you submit a resume or other information to Norwest again in the future, as well as for system administration, to perform research and analysis.
Norwest determines the retention period of your information based on the following retention criteria:
Norwest retains your personal data as long as it has an ongoing relationship with you;
For as long as allowed by applicable law, Norwest retains your personal data to match them against future open roles that we may want to inform you about;
Norwest retains your personal data where it is required to do so by a legal obligation to which it is subject;
Norwest retains your personal data where this is advisable to safeguard or improve Norwest’s legal position (for instance about statutes of limitations, litigation, or regulatory investigations).
Complaint procedure
If you have a complaint concerning the way we maintain the privacy of your personal information, please contact us as set out below. The directors will consider all complaints, and we may seek further information from you to clarify your concerns. If we agree that your complaint is well-founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.
Overseas transfer
The Company does not intend to share your personal information with third parties outside Australia. However, the Company does utilise online platforms, portals, and websites owned and operated by third-party organisations. Norwest does not operate said third-party organisations, which may occasionally engage international organisations or groups to service or maintain their online portals, websites, and platforms or provide any other type of service that requires access to any set of data held by the third-party organisation.
As such, your personal information may be transferred overseas or stored overseas for various reasons. It is impossible to identify every situation or country to which your personal information may be sent. Suppose your personal information is sent to a recipient in a country with data protection laws which are at least substantially like the Australian Privacy Principles and where there are mechanisms available to you to enforce the protection of your personal information under that overseas law. In that case, we will not be liable for a breach of the Australian Privacy Principles if your personal information is mishandled in that jurisdiction.
Suppose your personal information is transferred to a jurisdiction which does not have data protection laws as comprehensive as Australia’s. In that case, we will take reasonable steps to secure a contractual commitment from the recipient to handle your information in accordance with the Australian Privacy Principles.
